School of Rock Waiver & Codes of Conduct (Guardian)
The following Acknowledgements, Consents and Waivers must be signed by the parent or legal guardian of each student under the age of 18
SCHOOL OF ROCK RECURRING BILLING AUTHORIZATION
If you agree to recurring payments, it will be taken in the form of a credit card, debit card or ACH withdrawal at time of enrollment. Thereafter, your payment method on file will be automatically charged on a recurring basis for monthly tuition until you cancel.
All monthly automatic transactions will be charged to your account on the same date every month for the music instruction that will occur that month.
To end enrollment and cancel automatic charges, you must provide at least thirty (30) days’ notice. This includes any hold/hiatus you may need to take. To end enrollment under any program, you must call or speak to a management team member at the location where your student is enrolled to complete and receive confirmation of your cancellation. You may also email the location where your student is enrolled to request cancellation.
You agree that this Billing Authorization may be electronically signed. By typing your initials and pressing the button marked “Agree To This Document” you are stating that you have read, understand and agree to this Billing Authorization. You agree that your consent in this fashion is the same as a handwritten signature for the purposes of validity, enforceability, and admissibility. You can print or download a copy of this Billing Authorization, with your acceptance, after pressing “Agree To This Document” by navigating to the Signed Documents section of your Pike13 profile or by requesting a copy. You will also receive an email with a link to download the signed document.
I authorize School of Rock, LLC and/or its franchisees, as applicable, to debit my credit card or debit card account on file monthly for music tuition.
OVERVIEW
School of Rock cares about the safety of the children who come to our Schools and participate in our programs, events, activities, and trips. In order to ensure that School of Rock is a safe environment for our students and their families, we have established the following Codes of Conduct. Please read over this document thoroughly and sign where indicated. As parents, guardians, and children involved with School of Rock, it is essential that you understand these rules and commit to abiding by them.
PARENTS and GUARDIANS:
Please carefully and thoroughly review the School of Rock Student Code of Conduct with your child, as it explains the expected code of conduct to which your child is agreeing when enrolling in School of Rock.
PARENT/GUARDIAN AND VISITOR CODE OF CONDUCT
All parents/guardians and visitors to School of Rock premises or events should follow instructions and directives given by the School of Rock management at that location.
Parents/Guardians and visitors are expected to exercise appropriate, safe, and non-disruptive conduct at all times while on School of Rock premises or while at School of Rock events, activities, and trips.
Parents/Guardians should respect the teacher’s time and request to confer with teachers by arranging discussion times in advance.
Parents/Guardians may not disrupt instructional time with any student.
Parents/Guardians are expected to pick up their child from School of Rock on time. School of Rock is not responsible for students after school hours.
If there is a significant delay in the pick-up of your child, School of Rock may need to take additional measures to address the matter and will charge a late pick-up fee to be determined by School of Rock.
All students must remain on the premises while waiting for their parents.
School of Rock employees will respond to unsafe, disruptive, or disrespectful parent conduct by addressing the situation so that the student’s well-being is considered.
School of Rock expects mutual respect, civility, and orderly conduct among all people who visit the premises and events. No person on School of Rock premises or at a School of Rock event shall:
Strike, injure, threaten, harass, or intimidate a teacher/staff member/student or any other person;
Use vulgar or obscene language;
Damage or threaten to damage another’s property;
Damage or deface the property of School of Rock;
Violate any applicable federal, state, or local law or ordinance;
Smoke or otherwise use tobacco products;
Possess, distribute, or be under the influence of illegal drugs
Consume alcoholic beverages on School of Rock premises.
Impede, delay, disrupt, or otherwise interfere with any School of Rock event.
STUDENT CODE OF CONDUCT
School of Rock students are expected to:
Engage in safe, non-disruptive behavior at all times while on School of Rock premises and/or while participating in School of Rock events and activities.
Comply with School of Rock’s Alcohol and Drug Policy, prohibiting the use, possession, distribution, purchase, or sale of alcohol, drugs, and/or tobacco on School of Rock premises or at any School of Rock event or activity.
School of Rock prohibits students from:
Engaging in any kind of conduct that materially disrupts or adversely affects School of Rock programs or activities.
Using, possessing, distributing, purchasing, or selling any illegal drug, controlled substance, or alcohol.
Smoking, including e-cigarettes and vaping products.
Fighting or threatening teachers, staff, or other students.
Bullying or harassing teachers, staf,f or other students in any way, including but not limited to, based on a person’s sex or gender identity.
Damaging School of Rock or other students’ property and/or equipment.
Viewing inappropriate content on the Internet, cell phones, or any other media while on School of Rock premises or at School of Rock events.
Possessing, using, or distributing any type of weapon, including firearms, knives, or other dangerous objects.
School of Rock management will take disciplinary measures in response to student misconduct, which may include but are not limited to: a disciplinary conference, notification to parents/guardians, suspension, and expulsion from School of Rock. School of Rock management may also notify appropriate law enforcement authorities as appropriate, including whenever illegal conduct is suspected or observed.
STUDENT CODE OF CONDUCT - COMMITMENT TO COMPLY
I understand and agree to comply with School of Rock’s STUDENT Code of Conduct as described above. I have had the opportunity to discuss these items and to ask questions of School staff as needed.
STAFF CODE OF CONDUCT
Every School of Rock location is required to ensure all staff members comply with a Non-Fraternization policy prohibiting staff from contacting, communicating, or interacting with underage students outside of or unrelated to any School of Rock activities. As a parent, you should know and comply with the policy which is designed to ensure your student’s safety. Contact a management team member at your local school for a copy of their policy.
Prohibited fraternization activity includes, but is not limited to the following:
Corresponding in any way with underage* students through email without the parent being copied on the email.
Corresponding in any way with underage* students through text messaging, instant messaging, or social media sites. Instructors are not allowed to ‘friend’, follow, message, correspond, or in any way engage on social media with a student.
Calling underage* students by telephone outside of a direct relation to a student’s lesson, rehearsal, School of Rock program, event, or show.
Meeting with underage* students outside the school grounds for any reason other than one directly related to a School of Rock music program, show, or school-sponsored event. A parent must be in attendance.
Any meeting with an underage* student directly related to a School of Rock music program or show occurring off of school premises must be with the advance knowledge and approval of your Supervisor, the student’s parent(s), and must occur in an open or public place or in the presence of the parent(s).
Meeting with any student (underage* or adult) outside the school premises for the purposes of giving music lessons or teaching music
Visiting an underage* student at their home.
Traveling alone with an underage* student.
*An underage student is defined as anyone under the age of 18 OR enrolled/participating in a non-adult program.
PROHIBITION OF USE, POSSESSION, DISTRIBUTION, PURCHASE OR SALE OF ALCOHOL, DRUGS AND TOBACCO ON SCHOOL OF ROCK PREMISES OR RELATED TO SCHOOL OF ROCK INSTRUCTION OR EVENTS
School of Rock maintains a “zero tolerance” policy related to drugs, alcohol, and tobacco.
Using, possessing, distributing, purchasing, or selling tobacco, alcoholic beverages, or any illegal drug, controlled substance (including any prescription drug when not prescribed for the student by a physician or licensed practitioner, or when used in a manner inconsistent with the prescription or prescribing physician or licensed practitioner’s instructions), inhalant, cannabis (including marijuana and hashish) or drug paraphernalia while on School of Rock premises or related to participation in a School of Rock program or event of any kind including rehearsals, performances, and trips/tours regardless of location is strictly prohibited whether on or off the premises or facilities of School of Rock, and regardless of the particular laws of a state or country in which a student may be traveling with the School.
Failure of a student to abide by this policy may result in the student’s expulsion from the School of Rock program and the notification of local police authorities. If a student is expelled from School of Rock as a result of violating this policy, the student or his or her parent[s] will not receive a refund or return of any money, deposits, or fees paid to School of Rock. If the student is traveling with a School of Rock activity and is found to have engaged in conduct in violation of School of Rock’s policy prohibiting the use, possession, distribution, purchase, or sale of tobacco, alcoholic beverages, or drugs, he or she may be sent home, in the sole discretion of School of Rock with all costs of return transportation imposed on the student and his or her parent, which costs they agree to bear by signing below.
School of Rock expects the parents of its students to encourage and monitor their child’s compliance with this policy and to have serious discussions with their child regarding School of Rock’s “zero tolerance” policy prohibiting the use, possession, distribution, purchase, or sale of tobacco, alcoholic beverages or drugs, and the consequences for violating the policy; how crucial it is to adhere to School of Rock’s policy at all times and places; and, that other countries in which the student may travel with School of Rock may have punishments that may be very different than in the U.S. By signing below, parent[s] are acknowledging that they are responsible for having these discussions and have had such conversation(s) with their child who is a student at School of Rock.
EAR PROTECTION WAIVER AND RELEASE
Exposure to amplified sound for prolonged periods of time can result in permanent hearing damage. It is the student’s responsibility to possess and maintain hearing protection while participating in School of Rock activities. Students not adhering to the policy may be required to sit out of the School of Rock activity and will not receive a refund or return of any money, deposits or fees paid to School of Rock.
I understand the risks of me or my child not wearing earplugs or other protective hearing devices when participating in School of Rock programs as a performer, observer, or stagehand. Such programs (including but not limited to practicing, playing, and hearing rock music at loud levels) can cause permanent hearing damage or loss. I acknowledge that I have read School of Rock’s policy requiring the use of ear protection during rehearsals, live shows, or any activities with prolonged exposure to amplified sound.
I am aware that participation in these programs may entail known and unknown risks of injury to me or my child’s hearing and health. I expressly agree, for myself and on behalf of my minor child, to accept and assume all responsibility and risk for potential injury or damage to me or my minor child, to accept and assume all responsibility and risk for potential injury or damage to me or my child’s hearing or health that arises from participation in these programs. I freely elect for me and my child to participate in School of Rock's programs despite such known and unknown risks. I am advised by School of Rock that my child and I should wear protective hearing devices when participating in its programs because doing so may reduce the potential for hearing damage or loss.
In consideration of participating in School of Rock’s programs, I, for myself and for any minors for which I am the parent or legal guardian do on behalf of myself and such minors and on behalf of my and their heirs, personal representatives, or assigns, do hereby release and hold harmless School of Rock, LLC and its franchisees and their respective staff, consultants, representatives, agents, officers, directors, licensees, and affiliates (“School of Rock”), from any and all liability for hearing damage or loss of hearing or related injuries or damages suffered, and I hereby waive any lawsuit, claim or cause of action for damages arising from injury or damage to my hearing or loss of hearing as well as from any other personal injury resulting from my decision to participate in School of Rock’s programs. I further agree to accept full responsibility for any and all expenses, including medical expenses that may arise from any injuries that may occur as a result of me or my child's failure to wear protective hearing devices.
This release and waiver shall apply regardless of whether I or my child chooses to wear, or chooses not to wear, earplugs or other protective hearing devices.
CONSENT TO EMERGENCY MEDICAL TREATMENT
I consent to emergency medical treatment in the event such care is required as determined by the School of Rock. I agree to the use of my/my child’s personal medical insurance as the primary medical coverage if an accident, injury, or illness occurs and medical attention is needed while my child is participating in School of Rock programs, events, activities and trips. I acknowledge and agree that if I am not available to confirm or deny medical care or action for my child, my child will be transported to the nearest medical facility, and the medical professionals at that facility will make a determination regarding treatment.
PERMISSION TO USE STUDENT PHOTOGRAPHS, VIDEO, AND AUDIO PERFORMANCE RECORDINGS
You acknowledge and agree that parents, friends, students, media photographers, fans, and others, including School of Rock, will photograph, video, film, and record performances, sessions, rehearsals, and lessons that may include your child as a performer, as a spectator, and/or as a student (individually and collectively, the “Images and Recordings”). On behalf of yourself and your child, you hereby forever release, discharge, and agree to hold School of Rock, LLC and its franchisees and their respective staff, consultants, representatives, agents, officers, directors, licensees, and affiliates (“School of Rock”), harmless from any and all claims, regardless of form or origin, arising from the creation, use, or distribution of the Images and Recordings including without limitation any claims for copyright infringement, defamation, libel, invasion of privacy and/or publicity rights, and claims relating to any distortion or illusory effect.
Additionally, you agree that School of Rock, LLC and its franchisees and their respective staff, consultants, representatives, agents, officers, directors, licensees, and affiliates (“School of Rock”), shall have the right to collect and use the Images and Recordings and that School of Rock shall have the right to identify your child by name in the Images and Recordings, for the limited purpose of marketing and promoting School of Rock in all forms of media, now or hereafter known, including, but not limited to, in publications, on its and its affiliates’ website and/or in social media (the “Promotional Uses”). You grant permission to School of Rock to use the Images and Recordings for the limited purposes set forth herein.
You further acknowledge and agree that School of Rock does not control the distribution of Images and Recordings created by any person outside the control of School of Rock. This consent is valid for the entire time your child is enrolled for instruction and activities at the school and thereafter unless this consent is revoked in writing.
You hereby waive any right of inspection or approval of the Images and Recordings and/or the Promotional Uses. You also acknowledge and agree that School of Rock is not obligated to use any Images and Recordings that include your child in the Promotional Uses or otherwise. You also acknowledge and agree that School of Rock shall be deemed the sole owner and author of all Images and Recordings created by School of Rock.
PRIVACY POLICY
For company-owned locations, I acknowledge and agree that me and my child’s personal information will be collected and processed in accordance with School of Rock, LLC’s privacy policy located at: https://www.schoolofrock.com/privacy-policy. I also understand and acknowledge that if my school is a franchised location, such location is an independently owned and operated business, and I should contact the location for its privacy policy and practices.
CANCELLATION POLICY
There is a 30-day cancellation policy, and this includes any hold/hiatus you may need to take.
To end enrollment and cancel automatic charges, you must provide at least thirty (30) days’ notice. In order to end enrollment under any program, you must call or speak to a management team member at the location where your student is enrolled to complete and receive confirmation of your cancellation. You may also email the location where your student is enrolled to request cancellation.
Please notify a management team member at least 30 days prior to the student’s intended hiatus so that you will not be charged. Additionally, please contact a management team member two weeks prior to your child’s return to get them back on the schedule. Due to scheduling constraints, we cannot guarantee your student will have the same lesson time when they return.
MISSED LESSON POLICY
If a lesson is canceled by School of Rock for any reason (e.g. teacher illness, inclement weather), we will provide a make-up lesson at no additional cost. This does not include any closures for seasonal prep weeks or holidays. Due to scheduling constraints, the make-up lesson may or may not occur on the same day of the week as your typical lesson.
In the event you are unable to attend a lesson for your own reason, School of Rock will make efforts to arrange for a make-up lesson, provided, however, that you notify a management team member of your expected absence at least 24 hours prior to the scheduled lesson. Due to scheduling constraints, the make-up lesson may or may not occur on the same day of the week as your typical lesson, and may or may not be given by your regular instructor. If you fail to show up for your lesson or notify a management team member less than 24 hours prior to the scheduled lesson, you will not be eligible for a make-up lesson.
CLEANLINESS AND HYGIENE POLICY
At School of Rock, we prioritize the health and safety of our students, staff, and community by maintaining high standards of cleanliness and hygiene. To help prevent the spread of illness, we encourage proper hand hygiene before music lessons and require that anyone feeling unwell refrain from attending in-person sessions. Additionally, vocal students are required to bring their own microphone to rehearsals and performances.
HOLIDAY SCHEDULE
School of Rock is closed on New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day. Please check with your local school for their specific holiday schedule.
ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. I understand that School of Rock cannot guarantee that my minor child and I will not become infected with COVID-19. By participating in group and any other activities which could pose a higher risk of infection with COVID-19, I acknowledge, on my and My Child’s behalf, the contagious nature of COVID-19 and voluntarily assume the risk that My Child or I may be exposed to or infected by COVID-19 by attending the School of Rock and any activities or events hosted by School of Rock, and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I agree to follow School of Rock’s COVID-19 guidelines (as amended from time to time) during participation in any activities, as well as the guidelines of the Venue Operators, any Travel and Logistics Providers, any Host Jurisdictions to the extent that such guidelines are stricter than the then-current School of Rock COVID-19 guidelines.
REMOTE LESSONS
School of Rock is offering remote music lessons to parents and students when they cannot attend music lessons in person. School of Rock may also ask or require its instructors to conduct music lessons remotely.
Remote music lessons are conducted online and therefore not monitored or supervised at the School of Rock premises. The parent or guardian is expected to supervise the student during the entirety of any School of Rock remote music lessons.
SONGWRITING STUDENT RELEASE AGREEMENT
As a student at a School of Rock music school, “Student” (the undersigned student) may from time-to-time during enrollment in a School of Rock program compose, record (audio and/or video), critique, arrange or otherwise create original artistic works in which Student owns a copyright (the “Works”). School of Rock, LLC and its affiliates and their respective subsidiaries, affiliates, franchisor, franchisees, officers, agents, employees, and members (collectively, “School of Rock,” “We,” or “Us”) respect the intellectual property of others, including Student. Student, Student’s guardian, and We, therefore, agree as follows:
Works
The Works covered by this Agreement are limited to Works created solely by Student as part of School of Rock programming or in collaboration with other students currently enrolled in a School of Rock program. To the extent that editorial assistance is provided to Student from Us or other students, such assistance shall not be considered sufficient contribution to Student’s Works. As such, we shall hold no copyright interest in Student’s Works.
Copyright
We do not make any representations or assurances that Student’s Work is eligible for copyright protection or registration. A student is not required to file for copyright registration in any of his or her Works, and the terms of this Agreement shall apply to both registered and unregistered Works. Filing and prosecuting a copyright application(s) for Works will be entirely Student’s responsibility, inclusive of any legal assistance needed, and satisfaction of all requirements, deadlines, and financial obligations.
License Grants
Student’s guardian and Student hereby grant to Us a perpetual, irrevocable, royalty-free license to: publicly perform Student’s Works and recordings of the Works, including on the internet; transcribe, reproduce, and distribute sheet music of the Works; and record the Works, solely for the purposes of:
1) education of School of Rock students, inclusive of presentation to School or Rock students and their families;
2) promotion and advertising for School of Rock; and
3) adding the Works to streaming platforms and other online platforms.
All other rights in Student’s Works are reserved to Student and/or to Student’s collaborators as applicable.
AUTHORIZATION, WAIVER AND RELEASE
Read Carefully Before Signing. This is a Release of Liability and Waiver of Certain Legal Rights.
In consideration of the undersigned student’s participation in all School of Rock programs, events, activities and trips, I, for myself, as the participant or as parent or guardian on behalf of the participant and myself, and for my or my child’s heirs, personal representatives or assigns, do hereby indemnify, release and hold harmless School of Rock, LLC and its affiliates and their respective subsidiaries, affiliates, franchisor, franchisees, officers, agents, employees, and members (collectively, “School of Rock”) from any and all claims, demands, actions or causes of action and/or any and all liabilities and damages, including any or all costs, expenses, and attorneys’ fees, arising out of or in any way connected with, directly or indirectly, participation in School of Rock programs, events, activities and trips, and I do hereby waive, release and discharge any claim or cause of action against School of Rock for any and all damages and liabilities which may be sustained by the participant in connection with or as a result of participation in School of Rock’s programs, events, activities and trips.
I agree not to make any claim, suit or demand as myself, parent or guardian of and on behalf of the participant against School of Rock for any injury or damage incurred through participation in School of Rock programs, events, activities, and trips. This release is intended to discharge in advance School of Rock from any and all liability arising out of or connected in any way with the student’s participation in School of Rock programs, events, activities, and trips. Knowing and understanding the risks involved with participation in such School of Rock activities, I hereby voluntarily and willingly assume full and complete responsibility for all losses and damages, including injury, illness, and death, resulting from the student’s participation, including transportation to and from the activity. I further understand and agree that I am financially responsible for any losses and damages resulting from the student’s participation in School of Rock programs, events, activities, and trips.
I certify that the student is able to safely participate in School of Rock programs, events, activities, and trips. I consent to emergency medical treatment in the event such care is required as determined at the discretion of School of Rock. I agree to the use of my/my child’s personal medical insurance as the primary medical coverage if an accident, injury, or illness occurs and medical attention is needed while the student is participating in School of Rock programs, events, activities, and trips.
I understand that students participating in School of Rock's programs, events, activities, and trips are required to stay with the School of Rock group at all times to ensure their safety and the integrity of the program. I hereby voluntarily and willingly assume full responsibility for any losses, damages, or injuries—including illness or death—that may occur if I choose to leave or remove my child from the School of Rock group at any time during the duration of the School of Rock-related activities.
This Authorization, Waiver, and Release is freely and voluntarily given with the understanding that the right to legal recourse against School of Rock is knowingly given up in return for allowing the student’s participation in the activity. My signature on this document is intended to bind not only myself, but also my successors, heirs, representatives, administrators, and assigns. If signing on behalf of a minor, I acknowledge that I have full authority as parent or legal guardian to execute this Authorization, Waiver, and Release on behalf of the minor participant.
